Purchase Protection Programme for Sellers - South Africa

This Purchase Protection Programme ("Programme") is designed to provide South African sellers with protection and peace of mind when dealing with buyer cases. This document outlines the Programme's operation, eligible items, and qualifying transactions.

Legal Framework

These terms form part of our Terms of Use. By participating in the Purchase Protection Programme for sellers, you agree to these terms and our Terms of Use. This Programme:

  • Is not an insurance policy, warranty, or guarantee
  • Does not override or replace the Consumer Protection Act 68 of 2008
  • Does not affect your obligations under the Electronic Communications and Transactions Act 25 of 2002
  • Will be administered at our sole discretion regarding transaction protection
  • May be changed, suspended, or discontinued at any time, for any reason
  • Does not create any legal claim under the Programme
  • Does not affect buyers' rights to make claims against your shop under South African law

Programme Coverage

1. Scope of Protection

The Programme covers qualified sellers in the following scenarios:

1.1 Non-Delivery Cases:

  • Items that don't arrive at their destination
  • Orders that arrive after the Estimated Delivery Date
  • Protection applies when items are shipped within stated processing times

1.2 Item Accuracy Disputes:

  • Cases where buyers claim items don't match listing descriptions
  • Protection applies when items accurately match listing details and photos

1.3 Damaged Items:

  • Sellers are required to maintain appropriate insurance coverage for all goods sold
  • Sellers must process claims through their insurance provider for damaged items
  • Insurance documentation must be available upon request

2. Eligibility Requirements

To qualify for protection, sellers must:

A. Insurance Requirements

  • Maintain valid business insurance covering goods sold
  • Provide proof of insurance upon request
  • Process all damage claims through insurance provider

B. Shipping Documentation

  • Use valid tracking numbers
  • Purchase shipping labels through our platform (when available)
  • Mark orders as dispatched with valid tracking information

C. Payment Processing

  • Use our approved payment processing system
  • Alternative payment methods may disqualify orders from protection

D. Shipping Address

  • Ship only to the address provided during checkout
  • Decline address changes via messages to prevent fraud
  • Cancel and request new orders for address changes

E. Order Handling

  • Package items securely to prevent damage
  • Ship within stated processing times
  • Maintain accurate Estimated Delivery Dates (EDD)
  • Include transit times and postal codes where applicable

F. Shop Management

  • Complete digital orders through Shop Manager
  • Maintain comprehensive Shop Policies including:
    • Returns policy
    • Exchange policy
    • Custom order terms
  • Comply with South African consumer protection laws
  • Keep shop in good standing

3. Compliance Requirements

Sellers must comply with:

  • Consumer Protection Act 68 of 2008
  • Electronic Communications and Transactions Act 25 of 2002
  • Protection of Personal Information Act 4 of 2013
  • All applicable South African trade and consumer laws

4. Programme Updates

We reserve the right to:

  • Modify Programme terms
  • Update eligibility requirements
  • Suspend or terminate the Programme

Changes will be communicated with reasonable notice to participating sellers.
