1. Introduction
Welcome to AfterTheMarket, a product of Capable Technologies (Pty) Ltd (“Company,” “we,” “us,” or “our”). These “Terms” govern your access to and use of afterthemarket.co.za and its related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
2. Definitions
- “User,” “you,” and “your” refer to individuals and entities using the Service
- “Buyer” refers to users who purchase items through the Service
- “Seller” refers to users who list and sell items through the Service
- “Listing” refers to any item offered for sale through the Service
- “Transaction” refers to the buying and selling of items through the Service
3. Account Registration
3.1 Account Creation
- You must be 18 years or older to create an account
- You must provide accurate, current, and complete information
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized access to your account
3.2 Seller Verification
- Sellers must provide additional verification including:
- Valid South African ID document
- Proof of address
- Banking details for payments
- We reserve the right to reject seller applications at our discretion
4. User Responsibilities
4.1 General Conduct
Users agree to:
- Comply with all applicable laws and regulations
- Maintain accurate account information
- Use the Service in good faith
- Not engage in any fraudulent or harmful activities
- Not interfere with the proper operation of the Service
4.2 Seller Obligations
Sellers must:
- List items accurately and honestly
- Maintain accurate inventory
- Ship items within promised timeframes
- Use only PUDO for shipping
- Comply with all applicable consumer protection laws
- Maintain proper documentation for transactions
- Honor their commitments to buyers
4.3 Buyer Obligations
Buyers must:
- Make payments as agreed
- Provide accurate shipping information
- Collect items from PUDO points within specified timeframes
- Communicate responsibly with sellers
- Report any issues promptly
5. Listings and Transactions
5.1 Listing Requirements
- Items must be accurately described
- Prices must be clearly stated in South African Rand (ZAR)
- Prohibited items may not be listed
- Images must accurately represent the item
- Sellers must have rights to sell listed items
5.2 Prohibited Items
The following items may not be listed:
- Illegal goods or services
- Counterfeit items
- Hazardous materials
- Adult content
- Weapons and ammunition
- Controlled substances
- Items violating intellectual property rights
- Any items prohibited by South African law
5.3 Transaction Process
- Buyer places order
- Payment is processed
- Seller ships via PUDO
- Buyer collects from PUDO point
- Funds are released to seller after successful delivery
6. Payments and Fees
6.1 Payment Processing
- All payments must be made through our approved payment systems
- Prices are in South African Rand (ZAR)
- Payment must be received before shipping
6.2 Platform Fees
- Buyers will be charged a platform and protection fee of 5% + R14.50 above the seller's listed price
- Sellers are charged R2.50 per product listing when they have 100 or more active products
- Sellers payouts are charged R2.00 per transaction
- First 100 product listings are free for sellers
- All fees are non-refundable unless required by law
- Fees are automatically calculated and displayed during the transaction process
- We reserve the right to modify fees with 30 days notice
6.3 Fee Examples
For clarity:
- If a seller lists an item for R100, the buyer will pay:
- R100 (item price)
- R5 (5% platform fee)
- R14.50 (fixed protection fee)
- Total: R119.50
- A seller with 101 active listings will pay:
- First 100 listings: Free
- Additional listings beyond the free threshold: R2.50 per listing to enable the product.
7. Shipping and Delivery
7.1 PUDO Integration
- All shipments must use PUDO delivery services
- Sellers must provide accurate package information
- Buyers must collect items within specified timeframes
- Uncollected items will be returned to sellers
7.2 Delivery Times
- Sellers MUST ship items within 3 business days of receiving order
- Failure to ship within 3 business days may result in:
- Order cancellation
- Refund to buyer
- Negative seller rating
- Possible account suspension
- Delivery times to PUDO points are estimates only
- Force majeure may affect delivery times
- Sellers should mark items as shipped immediately after dropping off at PUDO
8. Returns and Refunds

9. Intellectual Property
- We retain all rights to the Service and its content
- Users retain rights to their own content
- Users grant us license to use their content for the Service
- Users must respect intellectual property rights
10. Limitation of Liability
- We are not responsible for user-generated content
- We do not guarantee continuous service availability
- We are not liable for indirect damages
- Our liability is limited to the extent permitted by law
11. Dispute Resolution
11.1 User Disputes
- Users should attempt to resolve disputes amicably
- We provide a dispute resolution process
- We may mediate disputes at our discretion
- We retain final decision-making authority
11.2 Platform Decisions
- Our decisions regarding disputes are final
- We may suspend accounts during investigations
- We may terminate accounts for violations
- We may refuse service to anyone
12. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any changes by:
- Posting the new Terms on this page
- Sending an email notification for significant changes
- Updating the “Last Updated” date
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
